VIVA – Direktur Jenderal Aplikasi dan Informatika Kementerian Komunikasi dan Informatika, Semuel Abrijani Pangerapan, menuliskan pemerintah menargetkan Rancangan Undang-undang (RUU) Perlindungan Data Pribadi sah menjadi UU pada 2019.
"Kami bercita-cita Surat Presiden terbit di mula tahun guna dibahas bareng DPR, dan targetnya berlalu tahun depan sebelum pengangkatan presiden yang baru," katanya saat bertukar pikiran dengan Lembaga Studi dan Advokasi Masyarakat (ELSAM) di Jakarta, Kamis 20 Desember 2018.
Ia mengatakan, ketika ini sedang terjadi polemik di pasal terakhir tentang hukum pidana pelanggaran data pribadi. Adapun dua pilihannya merupakan denda dan kurungan sekitar lima sampai enam tahun.
Deputi Direktur Riset ELSAM, Wahyudi Djafar berpandangan, perlunya hukum pidana untuk pelaku pembocoran data pribadi.
"Saat ini urusan itu yang menjadi persoalan. Ini butuh didiskusikan lebih jauh, apakah pidananya berlaku pun untuk individu, kemudian berapa lama kurungannya," katanya.
Untuk hukuman untuk korporasi, menurutnya, tidak masalah andai dikenakan denda. Namun, kata Wahyudi, denda untuk pribadi masih menjadi perdebatan. Bagi itulah penting untuk pelaku bisnis untuk mengawal kerahasiaan data pemakainya.
Pada dasarnya pengelolaan data individu oleh pihak pengelola mesti didasari oleh persetujuan dari empunya data. Perusahaan harus menyatakan lebih detail tentang data apa saja yang bakal dikelola dan berapa lama bakal dipelihara. (dhi)
